A Brief Overview Of The Insurance Appraisal Process

appraisal-disputeInsurance Appraisal Process Overview

In cases where there is no agreement between the insured and the insurance company over the actual amount (or cash value) it will cost to repair or replace damages, either party can make a demand that the dispute be settled by Appraisal. Each party selects an appraiser. The appraiser’s next duty is to first jointly select a competent and disinterested Umpire. Next, the appraisers will separately value and appraise the damages providing the amount they believe the damages will cost to bring the insured back to preloss condition (as if the loss or damage never occurred). If the appraisers are unable to jointly agree on the amount required they will submit their differences to the umpire.

Appraisal Panel

The independent appraiser for the policyholder and for the insurance company, along with the selected umpire, together constitute the appraisal panel. Determining the ‘amount of loss’ is the core objective of the appraisal panel. The next step is the reviewing of documents and estimates submitted by both the parties. This gives an idea about the differences in damages and cost as claimed by the policy holder.

A major benefit of the Insurance Appraisal Process is that the two independent appraisers are essentially impartial parties. The umpire is to be fair and impartial in their decision as they are not a part of the contract between the policyholder and the insurance company, prior to their involvement in the case. They approach the case with a cool head, without preconceived notions and with a mind to resolve the dispute based on actual facts.

Signing The ‘Award’

Once the reviewing and discussion between the three parties is complete, they reach the settlement or the final payable amount called ‘The Amount of Loss’. The document used is known as the Appraisal Award. Only two individuals on the appraisal panel are required to sign the Award, showing their agreed Amount of Loss. Once any two of them agree and sign the Award, the dispute is resolved and the amount on the Award becomes binding and has to be paid by the insurance company to the policyholder.

Mediation

Several insurance policies have added provisions for mediation as well along with the standard appraisal clauses. Mediation has a different approach of resolving the matter and is less costly. It is also not as binding as the appraisal, with respect to the policyholder.

Flood Insurance Reform Act Update

flood-signFlood Insurance Reform Update

New rules modifies specific conditions of  Biggert-Waters Flood Insurance Reform Act, which had been introduced in 2012, and tends to make more system adjustments to many other elements of this software not paid by that Take action. Numerous procedures in the Biggert-Waters Flood Insurance Reform Act remain, but simply being integrated. Although FEMA makes an effort to the law into practice, they motivate policyholders to keep and maintain recent flood insurance coverage. FEMA does not advise cancelling flood insurance coverage. If they reinstate in the future, Cancelling flood insurance policies now will leave policyholders unprotected during spring flooding and may cause policyholders to lose important discounts on their rate.
Carolyn McCarthy , D- N.Y. , released the following:

“Last month, President Obama signed into law the Homeowner Flood Insurance Affordability Act of 2014. This law repeals and modifies certain provisions of the Biggert-Waters Flood Insurance Reform Act, which was enacted in 2012, and makes additional program changes to other aspects of the program not covered by that Act.

For months, Congress has been working to address the unforeseen consequences of the Biggert-Waters Flood Insurance Reform Act of 2012, as well as to improve the accountability of the Federal Emergency Management Agency when it comes to the implementation of the flood insurance program.

Rep. McCarthy was a co-sponsor of this legislation which passed in the House in early March, and overwhelmingly passed in the Senate shortly after.

“As a Long Islander, I understand the frustration my neighbors are experiencing regarding flood insurance rate increases, especially in the wake of Superstorm Sandy. With the rising cost of other expenses, the financial burden of mandatory flood insurance has created an additional strain on many Long Island homeowners,” said the Congresswoman. “Reducing the financial burden and ensuring that the cost of flood insurance will not force anyone from their home, or reduce their ability to sell their home is a good start to bringing relief to those who have been burdened by FEMA’s flood insurance program. I am pleased to see that my constituents will benefit from this legislation in the near future.”

The Homeowner Flood Insurance Affordability Act contains a number of key provisions including: the repeal of certain rate increase triggers such as the sale of a home; the lowering of FEMA’s ability to raise rates from 20%-15%; the restoration of the “grandfathering” provision that would allow homeowners of properties built to code in the past to not have to worry about massive increases due to new mapping; and the requirement of FEMA to complete the affordability study and framework.

Quick Tips And Advice On Insurance

homeowners insurance claimsInsurance Advice & Tips

Insurance is a necessary evil in today’s world. It is important to protect yourself with insurance, but sometimes companies can look to “pull a fast one” on you in hopes of taking more of your money. Use the advice in this article to stay informed about insurance and what the best options are for you.

TIP! Each insurance company will differ in their own criteria for premiums and discounts. This allows for major variations in price between the different companies.

When involved in an insurance claim, do not wait for the insurance company to make all the moves. This will ensure that you get what you are owed, and in a timely manner. Be sure to provide any evidence that will be required and be persistent in asking for information directly related to your claim.

After a claim has been incurred, be sure to obtain an estimate from a contractor on your own. This will ensure that you can stand your ground versus an insurance adjuster as well as ensure you are getting a fair quote. If there is a debate, be sure to calmly confront your adjuster and assume that they are not trying to cheat you.

Homeowners

Buy more than one kind of insurance from the same company to save on all of your premiums. Bundled policies qualify for discounts with many insurers. The most common is probably a bundle that includes auto and homeowner’s insurance at a reduced rate. So if you are in the market for new policies, make sure you ask for home and auto quotes simultaneously and discover what your potential savings are.

TIP! It always a good idea to spend some time shopping for insurance coverage. Many people simply renew their insurance policies without investigating changes in the industry, since reevaluating their coverage from time to time takes work.

Find the best insurance company that covers everything you need. In many cases, having multiple insurance policies all from a single provider will net you a steep discount on your premiums. Moving your car policy from one company to the one covering your home for a lower car policy rate could raise your home rate.

To cover your home for earthquake damage in California, you must purchase separate earthquake insurance. Regular homeowner’s insurance will not cover quake damage. Your insurance company or broker can help you understand the risk in your area and provide the coverage for you. Many homeowners choose not to get earthquake coverage, as it can be quite expensive.

We live in a constantly changing world, and insurance helps us prepare in advance for these changes. Because of this, it is important to explore all of your options before purchasing insurance. Whether you are looking to protect yourself, your possessions, or your family, use the information in this article to be more informed.

Should The NFIP Cover The Same Properties For Multiple Claims?

Posted by Joe B | Posted in Home Insurance Claims, Insurance News, Uncategorized | Posted on 03-10-2014

flood-houseBeth Daley, an Investigative Reporter for the New England Center for Investigative Reporting writes about coastal homes that have suffered multiple flood claims over the past few decades. The main issue of the story is one property in particular that has suffered storm damages NINE (9) times! Now, tax payers and the government no longer wish to flip the bill for multiple insurance claims and occurrences for such properties.

This is a tough one. I hear the issue, the reasoning, and the cost, however, these property owners paid the insurance and the NFIP offered to cover the building.  What if you had two house fires and no insurance company offered you insurance and everyone said, “You’re on your own”? People would blow a gasket. In addition, the mortgage company forces these properties to have flood insurance and wind insurance. If you don’t obtain any, they force place your insurance for you at three times the cost.

It’s a very difficult situation. (BTW, I’m not a coastal land owner, just an insurance adjuster 🙂

“SCITUATE — Over and over again, the Atlantic has taken aim at 48 Oceanside Drive. Almost four decades ago, it slammed the seafront house clear off its foundation. Thirteen years later, ocean water poured through the roof during a nor’easter.

At least nine times the property has sustained significant flood damage from coastal storms. Each time, the federal government helped owners rebuild with National Flood Insurance Program payouts — a sum estimated to total more than three-quarters of a million dollars.

The property’s tortured history and the government’s open wallet highlight the central question as Congress debates changes to the flood insurance program: At a time of rising tides and soaring deficits, does the program create incentives for owners to stubbornly keep homes in places the sea is claiming as its own? Joe, I send this correspondence together with a sincere deep appreciation for the exceptional work which you performed for our family. We could not be any happier with the outcome of the appraisal process. At the time of my initial telephone contact with you several months ago, I was feeling deep frustration in pursuing my roofing claim against our insurer. It was evident to me that I was in need of an experienced appraiser with an extensive background in the construction and roofing industries. I feel very fortunate in having located you via the internet. Your approach was thorough, directed, and highly effective in gaining the positive result which both of us desired. My wife and I join in thanking you for the professional way in which you pursued our claim and the excellent results obtained. By  March 28, 2012 at 09:26 AM

Exceeded Our Expectations

http://www.insuranceclaimsgroup.com/testimonials/#rausch

I just wanted to drop you a line and say how grateful we are that we found you online. We had a black water flood from our second floor bathroom through the dining room, into the first floor bath and then seeped into the basement family room. Our insurance Co. (*******) came out three different times to do an appraisal on the damage, max we would have gotten was $6,000.00.  They were still far off from any estimate from a construction company to do the work. Then we found this little clause in our insurance policy that nobody told us about, “Our right to Appraisal” that’s when we found Joe and just took over.  He not only took control of our claim with the insurance co. but guided us through the process. In the end he got us over $33,000.00 now we can complete the work on our home the right way not the half *** way.  We got our last check today. Case closed. Yea baby. It pays to read the fine print of your ins. policy and the right person handling our case.  Thank you for all your hard work and dedication.  By  Larry and Colleen Gibson
